To start with I am not an attorney. The only experience I have is from behind bars. Oh yes I was stupid and I have done my time, well almost. My mistake was to plead guilty to a crime of rape in the year 1971. Notice I did enter a plea bargain that was thrown out by the judge, yet he kept my guilty plea.. None of what I just said is on record.
That alone is a serious violation of my due process rights, and one that I have contested to no avail. Since then it took me 33 years to complete a 20 year sentence. Each time I was paroled I would screw up again and find a conviction violation witch would cause my free time to be revoked and I would have to start all over again.
So here I am 40 years later and I now have to register as a sex offender. I am told that it is not a violation of my rights of ex-post facto, because the law is a civil law to protect the citizens of North Carolina. Yet my movements are restricted, my ability to earn a living has been limited, my choices of what church I wish to attend has been limited and my freedom of speech is being looked into because I am on the internet.
I am presently charged with being on face book. I have no idea of how the courts will decide nor what my attorney will want to do about the charges. I do know that the whole thing is just one more nail in my freedom coffin.
Before I go allow me to point out that in 1983 after going to trial 3 times, a charge of molestation of a minor was dismissed and I was found of indecent liberties because I spanked her on her bottom. (not my child, and only good swat)
Other than that, I have not been accused of or investigated for any other sex offense. That alone should have been enough for the powers that be to leave me alone, but as I am told the law is the law.
Is there any and I repeat any help for this trajic set of circumstances that I find myself in?
